What is a Mortgagee Sale?
A mortgagee sale is the sale of a borrower's property by the mortgagee (financier/bank). It follows the borrower's default eg: non payment of the loan, under his or her mortgage. Note under the Property Law Act 2007, the mortgagee owes a duty of reasonable care to obtain the best price reasonably obtainable as at the time of sale.
